the german academic exchange service (daad) supported an addition to the georgetown german program for a three-week summer seminar in the social sciences, funded by the daad 2013 grant project: «german course for social sciences.» over 20 participants from 10 institutions in the u.s., including four universities in germany and four in austria, attended this seminar.

a few months back i came across a video series that talked about a very interesting concept called ‘pietà’, the practice of the roman catholic church of displaying the dead christ holding his own dead body. as it turned out, this practice has a little more to do with ancient roman law and practice than modern catholic practice. most sources tend to do a disservice in describing roman law, but that doesnt mean that we cant learn some useful information about it. here are a few things that we can glean from the subject:

  • rome was an empire with a large population of criminals, of whom only those found guilty were executed. the entire empire had more criminals than it did inhabitants in a ratio of four to one.
  • no roman citizen could be punished by the state without due process.
  • this meant that the accused could not be killed or incarcerated before the trial without a process that was guaranteed under law.
  • rome was a leader in the development of criminology, and practiced what we today would consider the modern practice of research and ‘evidence’, thereby separating the process of investigation from the process of punishment.
  • rome was also one of the first to separate the court of law from the executioner, who typically took care of executing prisoners. in this instance it was done by having the executioner wear a red robe that his own family members could recognize, allowing them to protest the execution and thereby freeing the condemned.
  • the convicted would be allowed to hold a public orating contest before their sentence was carried out, so that they could express their thoughts to the public.
